Privacy Policy

1. Data Controller. The data controller is SkyMatrixLabs, registered at Calle San Vicente Mártir, 65, Piso 3A — 46002, Valencia, Valencia, España. For any data-related inquiries, contact us at [email protected].

2. Data Collected. We collect personal identification data (name, email address, phone number) submitted voluntarily through our contact forms. We also collect standard server log data including IP addresses, browser type, operating system, and access timestamps for security and diagnostic purposes.

3. Legal Basis for Processing. Personal data is processed under Article 6(1)(b) of the GDPR (performance of a contract) and Article 6(1)(f) (legitimate interest in responding to business inquiries and improving our services).

4. Data Usage. Collected data is used exclusively for: responding to inquiries, delivering requested services, maintaining communication records, and improving service quality. We do not sell, rent, or share personal data with third parties for marketing purposes.

5. Data Retention. Contact form submissions are retained for a maximum of 24 months from the last interaction. Server logs are rotated and purged every 90 days. Contract-related data is retained for the duration required by Spanish commercial law (minimum 6 years).

6. Data Security. All data is transmitted via TLS 1.3 encryption. We implement appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction.

7. Your Rights. Under the GDPR, you have the right to access, rectify, erase, restrict processing, port, and object to the processing of your personal data. You may also withdraw consent at any time. To exercise these rights, contact [email protected].

8. International Transfers. Data is processed within the European Economic Area (EEA). Any transfer of data outside the EEA will be subject to appropriate safeguards under Chapter V of the GDPR, including Standard Contractual Clauses where applicable.

9. Supervisory Authority. You have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos — AEPD) at www.aepd.es if you believe your data processing rights have been violated.

Cookies Policy

1. What Are Cookies. Cookies are small text files stored on your device when you visit a website. They enable the site to recognize your device and store information about your preferences or past actions.

2. Essential Cookies. SkyMatrixLabs uses strictly necessary cookies to ensure the website functions correctly. These include session management tokens, security cookies, and preference storage (e.g., cookie consent status via localStorage). These cookies do not require consent under the ePrivacy Directive.

3. Analytics Cookies. We may deploy analytics cookies (e.g., Google Analytics) only after explicit user consent. These cookies collect anonymized data about page views, session duration, and navigation patterns to help us improve our services.

4. Third-Party Cookies. Embedded content (e.g., Google Maps on our contact page) may set their own cookies under their respective privacy policies. SkyMatrixLabs does not control these third-party cookies.

5. Managing Cookies. You may disable or delete cookies through your browser settings at any time. Note that disabling essential cookies may impair website functionality. Most browsers allow you to block cookies from specific domains while permitting others.

6. Consent. Upon your first visit, a cookie consent banner will appear. Non-essential cookies will only be activated after you provide explicit consent by clicking the acceptance trigger. Your consent status is stored locally and will persist until you clear your browser data.

Refund Policy

1. Scope. This Refund Policy applies to all services provided by SkyMatrixLabs, headquartered at Calle San Vicente Mártir, 65, Piso 3A — 46002, Valencia, Valencia, España.

2. Project Milestones. Payments are structured around agreed project milestones. Refund eligibility is evaluated based on the completion status of each milestone. Work that has been delivered and accepted is non-refundable.

3. Cancellation Before Work Begins. If a project is cancelled before any work has commenced, a full refund of any advance payment will be issued within 14 business days, minus any non-recoverable third-party costs (e.g., domain registrations, software licenses already procured).

4. Cancellation During Active Work. If a project is cancelled after work has begun, a proportional refund will be calculated based on the percentage of work completed relative to the total project scope. The client will receive a detailed breakdown of completed and remaining tasks.

5. Defective Deliverables. If a delivered milestone does not meet the agreed-upon specifications, SkyMatrixLabs will, at its discretion, either rectify the defects at no additional cost or issue a partial refund for the affected milestone. Defect claims must be submitted in writing within 14 days of delivery.

6. Refund Method. All refunds will be processed using the original payment method. Processing times vary by payment provider but will not exceed 30 business days from approval.

7. Dispute Resolution. In the event of a dispute regarding refund eligibility, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal remedies under applicable Spanish consumer protection law.

Terms of Service

1. Acceptance. By engaging the services of SkyMatrixLabs (Calle San Vicente Mártir, 65, Piso 3A — 46002, Valencia, Valencia, España), the client agrees to be bound by these Terms of Service. These terms constitute the entire agreement between the parties.

2. Scope of Work. All project deliverables, timelines, and pricing are defined in the individual project proposal or statement of work (SOW) agreed upon by both parties. Any changes to the scope must be documented in a written change order signed by both parties.

3. Payment Terms. Invoices are issued according to the milestone schedule defined in the SOW. Payment is due within 14 days of invoice date. Late payments incur a 2% monthly interest charge. Work may be suspended if payment is more than 30 days overdue.

4. Intellectual Property. Upon full payment, all intellectual property rights for the delivered work product are transferred to the client. SkyMatrixLabs retains the right to display the work in its portfolio and case studies unless the client objects in writing. Pre-existing frameworks, libraries, and tools used during development remain the property of SkyMatrixLabs.

5. Confidentiality. Both parties agree to maintain the confidentiality of proprietary information exchanged during the course of the engagement. This obligation survives the termination of the agreement for a period of 3 years.

6. Limitation of Liability. SkyMatrixLabs’ total aggregate liability under any engagement shall not exceed the total fees paid by the client for the specific project. SkyMatrixLabs shall not be liable for indirect, incidental, consequential, or punitive damages.

7. Warranty. SkyMatrixLabs warrants that all deliverables will conform to the agreed specifications for a period of 90 days following delivery. This warranty does not cover issues arising from client modifications, third-party integrations, or changes in external platforms.

8. Termination. Either party may terminate the agreement with 14 days’ written notice. Upon termination, the client will receive all completed work and will be invoiced for any outstanding milestones that have been completed or are in progress.

9. Governing Law. These terms are governed by the laws of the Kingdom of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain.
